In the cases where the packages are declared as a Loss due to theft and/or loss, the customer has the right to request indemnity insurance. This insurance is governed by the current legislation on land transport in Spain, specifically by the Law of the Contract of Land Transport of Goods (LCTTM).
In accordance with Article 57 of the LCTTM, the maximum limit of compensation for loss or damage to transported goods is set at one third of the daily Public Indicator of Multiple Effect Income (IPREM/day) for each kilogram of gross weight of the goods affected.
It is important to bear in mind that, at the time of writing these policies (year 2025), the daily value of the IPREM for the current fiscal year has not yet been officially published in the General State Budget.
However, taking as a reference the value of the daily IPREM corresponding to the year 2024, set at €20/day, the maximum limit of compensation would be estimated at approximately 6.67 euros per kilogram of lost or stolen goods.
Points to consider for the claim:
- Actual value of the merchandise: The indemnity to be received shall never exceed the actual value of the merchandise that has been subject to loss or damage.
- Documentation required: In order to proceed with the payment of the corresponding indemnity, it will be essential to present the original purchase invoice of the lost/damaged product, which will serve as proof of the actual value of the same.
- Deadline for delivery of documentation: The requested documentation must be provided within a period of no more than 60 days from the date of issue of the letter opening the indemnity file. In the event that the documentation is received after 60 days of the aforementioned letter, the indemnity claim will be dismissed.
- Payment of compensation: The amount corresponding to the approved indemnity will be added to the client's wallet during the first 5 to 10 working days of the month following the month in which the complete and correct documentation has been provided.
